Affidavit Evidence Document Review
Here's a skill that reviews affidavits prepared by Counsel in support of a motion on notice and written address, and checks the paragraphs against section 115 of the Evidence Act of 2011 (as amended).
What it does
Section 115 requires an affidavit to contain only statement of facts. It forbids extraneous matter by way of objection, prayer, legal argument or conclusion. If an affidavit is filed with such paragraphs, opposing Counsel may ask the Court to strike them out which can weaken a party's case.
This skill reviews the affidavit paragraph by paragraph and:
-identifies paragraphs that are couched as objection, prayer, legal argument or conclusion. -explains the consequences of retaining such paragraphs. -suggests how each paragraph should be reworded so it states facts only.
What You Get
- A paragraph-by-paragraph table showing the status (Compliant or Problematic), the issue, and suggested wording.
- A short summary stating whether the affidavit is ready to file or should be revised first. -A list of facts that Counsel needs to confirm.
